Branstad announces the new group at the NAACP's Iowa Summit on Justice & Disparities

(ANKENY, Iowa) - Iowa Gov. Terry E. Branstad today announced the formation of the Governor's Working Group on Justice Policy Reform at the Iowa Summit on Justice and Disparities. The summit, which was organized by the Iowa-Nebraska State Conference of Branches for the National Association for the Advancement of Colored People (NAACP), is being held today at the FFA Enrichment Center at Des Moines Area Community College in Ankeny, Iowa.

The purpose of the working group is to research and make policy recommendations related to reforms in Iowa criminal justice practices. The group will consist of a core group of experts on justice polices, and have the access to all state agencies and resources for information and assistance. The working group will allow for public input.

"Over the past few years, I have been pleased to have regularly-scheduled meetings with the Iowa-Nebraska State Conference of Branches for the NAACP, where we have the opportunity to visit about challenges in Iowa's justice and corrections systems and how we can work together to improve any potential disparities," said Branstad. "These conversations have been substantive, informative and productive. Already, Iowa is decreasing prison population while simultaneously reducing the recidivism rate. I recognize that there is an opportunity to make even more improvements. I look forward to learning what recommendations the working group presents and will carefully review how the state might implement them moving forward."

The working group will be charged with developing a strategy to better modernize and increase equity in Iowa's criminal justice policies. The governor will ask the working group to focus its work on the following specific policy areas and how to improve them - mental health and drug court diversion programs, jury pool selection, juvenile criminal record confidentiality and state prison and county jail phone call fees.

The working group will consist of the following individuals/representatives:

1.       Representative from the Iowa Attorney General's Office

2.       A State Court Administrator

3.       State Public Defender

4.       Commissioner of Iowa Department of Public Safety

5.       Representative from the NAACP

6.       County Attorney Representation

7.       Representative from the Iowa Department of Corrections

8.       Representative from the Iowa Parole Board

The Governor's Working Group on Justice Policy Reform will present a written report to the governor, stakeholders, and the public no later than November 1, 2015, so that the Iowa Legislature can consider these recommendations in the 2016 legislative session.

Making False Statements in Purchase of Firearms
DAVENPORT, IA - On August 26, 2015, Jenifer Tran, age 41, was sentenced by United States District Court Chief Judge John A. Jarvey to time-served and three years of supervised release, with six months of home confinement, on a charge of making false statements during the purchase of firearms, announced United States Attorney Nicholas A. Klinefeldt. Tran was also ordered to pay $100 towards the Crime Victims Fund.
On August 14, 2014, the Davenport Police responded to a 911 call at the residence of Charles Bryan Ewert in Davenport, Iowa, in reference to a domestic disturbance. The caller related she had been physically and emotionally abused by Ewert, he had threatened to kill her, and he had multiple firearms at the residence. Davenport Police surrounded the residence and attempted to make contact with Ewert. He was uncooperative and the situation was handled as a barricaded suspect who was possibly armed. Ewert was observed by officers entering and leaving the garage during the stand-off. After about an hour, Ewert was arrested.
A search warrant was obtained for the residence and a search was conducted. Eight firearms were recovered in the garage along with a large amount of ammunition for various types and calibers of firearms including a Springfield Armory M1A, 7.62 caliber rifle, a Ruger P95, 9mm semiautomatic pistol, and a Remington 870, 12 gauge shotgun. These firearms were traced to Tran, and it was determined that the firearms were purchased by Tran for Ewert, at Ewert's request.
When purchasing the firearms on December 11, 2011, Tran completed a federal firearm transaction form required by law. In so doing, Tran falsely answered "yes" to the question: "Are you the actual transferee/buyer of the firearms(s) listed on this form? Warning: You are not the actual buyer if you are acquiring the firearm(s) on behalf of another person. If you are not the actual buyer, the dealer cannot transfer the firearm(s) to you.", when in fact Tran purchased the firearms for Charles Bryan Ewert.
This case was investigated by the Davenport Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). The case was prosecuted by the United States Attorney's Office for the Southern District of Iowa.

Jarvey to 84 months in prison for being a felon in possession of eight firearms and for making false statements during the purchase of a firearm, announced United States Attorney Nicholas A. Klinefeldt. Ewert was also ordered to serve three years supervised release following the imprisonment and to pay $200 towards the Crime Victims Fund. Ewert agreed to forfeit his interest in the firearms and ammunition he illegally possessed.

The firearms include : (1) a Bushmaster Carbon 15 (AR15) .223 caliber semiautomatic rifle, (2) a Springfield 87A, .22 caliber rifle, (3) a Glock Model 22 .40 caliber semiautomatic pistol, (4) a Springfield Armory M1A, 7.62 caliber rifle, (5) a Winchester 50, 12 gauge shotgun, (6) a Winchester 12, 12 gauge shotgun, (7) a Ruger P95, 9mm semiautomatic pistol, and (8) a Remington 870, 12 gauge shotgun. Ewert was convicted in 2002 of felony eluding, a crime punishable by imprisonment for a term exceeding one year. The Glock pistol was traced to a federal firearms licensee, who produced copies of a gun permit, driver's license, and Form 4473 for a person with the name of a Davenport businessman. 

The police interviewed the Davenport businessman, who said he provided a copy of his driver's license and copy of his gun permit to Ewert as they were jointly purchasing the firearm. He said it was Ewert who purchased the firearm using these copies. The businessman sold the Bushmaster Carbon 15 to Ewert in a separate transaction. The police re-interviewed the federal firearms licensee, who admitted that he sold the Glock pistol to Ewert after being provided the identification documents in the name of the businessman.

This case was investigated by the Davenport Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). The case was prosecuted by the United States Attorney's Office for the Southern District of Iowa.

WASHINGTON - Senator Chuck Grassley, Chairman of the Senate Judiciary Committee, is continuing his efforts to learn more about the process that allowed top secret classified information to be sent on unsecure communication lines and the subsequent possession of this classified material on improperly secured storage devices.  

   

Asking additional questions, Grassley wrote in a letter to Secretary of State John Kerry, "The transmission of classified material to an individual unauthorized to possess it is a serious national security risk.  Moreover, if a person unauthorized to maintain custody of classified materials does in fact maintain custody, it raises legitimate questions as to whether the information was properly secured from foreign governments and other entities."   

   

Grassley's questions come on the heels of a response from former Secretary of State Hillary Clinton's personal attorney, David Kendall, to questions regarding Kendall's security clearance during the time he was in possession of thumb drives containing Clinton's State Department emails.  According to the Inspector General for the Intelligence Community, a small sample of the emails contained top secret/sensitive compartmented information when generated. 

Kendall's response to Grassley notes that he and his law partner, Katherine Turner, obtained top secret clearance from the State Department in November 2014 and December 2014, respectively.  In December 2014, Kendall and other unnamed attorneys sent Clinton's emails to the State Department.   Kendall notes that the State Department clearances were obtained, "in order to be able to review documents at the Department of State, to assist former Secretary Clinton in preparing to testify before the House Select Committee on Benghazi."  (emphasis added).  Yet, his office retained electronic copies of the emails, rather than turning over all copies to the State Department.  On August 11, 2015, the Inspector General for the Intelligence Community notified congressional offices that two of the four emails contained information classified up to Top Secret/SCI/TK/NOFORN when generated.  According to Kendall, neither he nor Turner had a clearance issued at that level from the State Department. Consistent with the understanding that Kendall and Turner's classification was not sufficient, the FBI is now in custody of all thumb drives previously in their possession as well as the non-government server Clinton used for email during her tenure at the State Department.

WASHINGTON - Reiterating concerns about national security information being properly secured from foreign governments and other entities, Senator Chuck Grassley, Chairman of the Senate Judiciary Committee, is asking Hillary Clinton's private attorney, David Kendall, about his security clearance in conjunction with his representation of the former secretary of State.

In a letter to Kendall, Grassley is asking for confirmation of when, how and why he or any of his associates received a security clearance in connection with the firm's representation of Clinton and whether it was active while he had custody of Clinton's emails.

Grassley wrote that media reports indicate that, "Secretary Clinton may have provided you copies of her emails in December 2014 and that government officials realized that the emails contained classified information in May 2015 yet the Department of State did not deliver a safe to store the thumb drives until July 2015."

Grassley added, "Thus, since at least May 2015 and possibly December 2014, it appears that in addition to not having an adequate security clearance, you did not have the appropriate tools in place to secure the thumb drives."

Grassley has asked the FBI and the State Department about the agencies' efforts to secure the top secret classified information on the clintonemail.com server and the thumb drives in Kendall's possession.  Neither the FBI nor the State Department has responded to Grassley's questions.

John R. Baldwin to lead Illinois Department of Corrections

 

SPRINGFIELD - Governor Bruce Rauner has nominated John R. Baldwin to become the next Director of the Illinois Department of Corrections. Baldwin is the former Director of the Iowa Department of Corrections and brings more than 35 years of overall experience to the position.

Baldwin led the Iowa Department of Corrections from January 2007 until his retirement in January of this year. As the director he oversaw a staff of nearly 4,000 officers who supervised 38,000 offenders. During his tenure, he worked with the Pew-MacArthur Results First Initiative to build a state-specific cost-benefit analysis on the state's corrections department. The data was used to make more informed policy and budget decisions in an effort to reduce recidivism.

Baldwin began working for the Iowa Department of Corrections in 1983. In addition to his leadership as Director, Baldwin was the Deputy Director of Administration where he oversaw a number of areas including the budget, personnel and evidence-based practices. Prior to that, he supervised the business office for a forensic psychiatric hospital that was under the control of the Iowa Department of Corrections.

Baldwin holds a master's degree in political science from Iowa State University and a bachelor's degree in economics from the University of Iowa.

(DES MOINES) - On Thursday, August 6, 2015, Gov. Terry E. Branstad denied the following applications for commutation:

Bruce A. Hatter, age 53, committed his crime on December 1, 1981, in Linn County.  He is currently serving a life sentence for first-degree kidnapping.

Fred L. Ruble, age 54, committed his crime on January 9, 1982, in Woodbury County.  He is currently serving a life sentence for first-degree kidnapping.

Gary A. Winnett, age 51, committed his crime on March 2, 1987, in Boone County.  He is currently serving a life sentence for first-degree murder.
