Des Moines, September 15, 2015– The Iowa Judicial Branch will join the Iowa Department of Education and The Iowa State Bar Association to present a Constitution Day program for Iowa high school students on Thursday, September 17. Students from Panorama High School, Des Moines Scavo High School, and Hampton-Dumont High School will attend the Iowa Supreme Court oral arguments that begin at 9:00 a.m. Ballard High School students will attend the afternoon oral arguments that begin at 1:00 p.m. Both sessions are in the Supreme Court Courtroom on the fourth floor of the Judicial Branch Building and open to the public.

"It's very important that Iowa students understand the significance of the Constitution and their duty to be informed United States citizens," Iowa Department of Education Director Ryan Wise said. "One way we do this is through Constitution Day activities, including our student-centered partnership with the Iowa Judicial Branch. If we want our students to graduate prepared for success in college and the workforce, they must have the knowledge and skills to be active, engaged citizens."

For students unable to attend the oral arguments, the program includes an online orientation video that students in classrooms across the state will be encouraged to watch before live streaming the morning or afternoon oral arguments.

"The justices of the supreme court enjoy welcoming students to see the work of the judicial branch of their government first hand on Constitution Day," Chief Justice Cady said. "It is an excellent opportunity for high school students to learn about the importance of the Iowa and United States Constitutions. We should all take time during the day to reflect on the genius of the 39 delegates to the constitutional convention who signed the U.S. Constitution 228 years ago and the 55 Iowans who signed the Iowa Constitution 70 years later."

The nine-minute orientation video, entitled "We the People: The Iowa Constitution and Our Courts," begins with Chief Justice Mark Cady addressing the importance of the Iowa Constitution and how the courts use the document to resolve disputes between Iowans. Then, Justice Daryl Hecht explains how a person can appeal a case to the supreme court and what happens during oral arguments. Constitution Day recognizes the ratification of the Constitution of the United States on September 17, 1787. In 1911, the State of Iowa was the first state to celebrate Constitution Day. In 2004, legislation established the Federal observance of Constitution Day.

Des Moines, July 24, 2015 – The Iowa Supreme Court Lawyer Trust Account Commission is accepting applications for grants in a special program funded by a $346,652.88 Bank of America donation. Under the terms of the donation, these funds must be used by legal aid organizations in Iowa, for foreclosure prevention legal assistance and community redevelopment legal assistance.

Applicants must agree to participate in a data collection program intended to demonstrate the impact of the settlement funds in the grant purpose areas. Additional information is provided in the commission's request for proposals.

The commission's Interest on Lawyer Trust Account (IOLTA) grant application form will be used for this special program. The request for proposals and the application form are available in paper and electronic form by contacting the Lawyer Trust Account Commission, Judicial Branch Building, 1111 East Court Avenue, Des Moines, Iowa 50319, by calling (515) 725-8029, or by electronic mail to iolta@iowacourts.gov. Legal aid organizations wishing to apply must file one copy of their application in paper form, and one copy of their application in electronic form. The commission will then review the applications and seek approval from the Iowa Supreme Court for awarding the grants. The commission expects that grant recipients will be announced in September of 2015.

The donation is part of an August 2014 U.S. Department of Justice $16.65 billion settlement with Bank of America and its former and current subsidiaries, including Countrywide Financial Corporation and Merrill Lynch. The settlement resolved civil investigations relating to residential mortgage-backed securities, collateralized debt obligations, and practices concerning the underwriting and origination of loans. More than $30 million of the settlement was allocated to IOLTA programs in the U.S. for foreclosure prevention programs and community redevelopment legal services.

Des Moines, August 25, 2014– The Iowa Supreme Court will hold a public hearing Wednesday, August 27, 2014, on the fourth floor of the Judicial Branch Building, 1111 East Court Avenue, Des Moines, beginning at 9:00 a.m.

The supreme court will hear public input on a recommendation proposed by The Iowa State Bar Association's Blue Ribbon Committee on Legal Education and Licensure (ISBA) to amend the Iowa Court Rules. The ISBA recommends that Iowa adopt a "diploma privilege" to admit graduates of Drake University Law School and the University of Iowa College of Law to the practice of law in Iowa absent the required taking and successful completion of the current Iowa Bar Examination. An additional recommendation is for Iowa to adopt the Uniform Bar Examination for bar applicants who would not qualify for the diploma privilege.

The daylong schedule consists of oral presentations from individuals expressing different viewpoints on the proposed rule. The comments begin at 9:00 a.m. There will be breaks at 10:50, 12:20, and 2:30. The public hearing will be streamed live over the Internet. Des Moines, February 24, 2014 –On Tuesday evening, March 4, the Iowa Supreme Court will hear oral arguments in the case of Godfrey v. State of Iowa, et al., beginning at 7:00 p.m. in the Supreme Court Courtroom on the fourth floor of the Judicial Branch Building, 1111 East Court Avenue, Des Moines. The evening session is an opportunity for central Iowa residents, who may not be able to attend the court's regular morning and afternoon sessions, to watch the court conduct oral arguments.

In this case, the Iowa Supreme Court will be asked if tort claims against state officials must be brought under the Iowa Tort Claims Act, Iowa Code chapter 669. The statute provides that if the actions of state employees that are the basis of the claim were within the scope of their employment, the employees have immunity and the State of Iowa will be substituted as defendant for the individual employees.

Plaintiff Christopher Godfrey is serving a statutory six-year term as Iowa's Workers' Compensation Commissioner. His term is due to expire April 30, 2015. He has sued the State of Iowa and several individuals, including Governor Terry Branstad and Lt. Governor Kim Reynolds, on a variety of claims, including violation of his constitutional rights, defamation, and intentional interference with contract.

Under Iowa Code section 669.5, the Iowa attorney general certified that defendants' actions were within the scope of their employment with the state. Based on the attorney general's certification, the individual defendants asked the district court to substitute the State of Iowa as the sole defendant in the case. The district court concluded that chapter 669 mandated a finding that the attorney general's certification on scope of employment was conclusive, requiring the court to substitute the State of Iowa for individual defendants. Plaintiff Godfrey contends the district court was wrong to dismiss the individual defendants from the case.

On appeal of the district court's ruling, issues before the Iowa Supreme Court include :

I. Does the attorney general's certification pursuant to Iowa Code section 669.5(2)(a) conclusively establish that a state employee was acting within the scope of his or her employment (and therefore the action is deemed to be an action against the state and the state is substituted as the defendant in place of the employee) or is the attorney general's certification subject to the court's (or a jury's) independent review?

II. If the attorney general's certification does conclusively establish that a state employee was acting within the scope of employment, then does the application of section 669.5(2)(a) result in an unconstitutional deprivation of plaintiff's due process rights?
