Bringing the bill out of committee now triggers a conference committee between the version passed by the Senate Ag Committee and the House version. The House passed their version in April.

The bill, introduced by House Ag Committee Chair Glenn “GT” Thompson, would update the H-2A visa program by expanding access beyond “seasonality,” control associated costs, and streamline the visa program process.

Currently dairy farms are not eligible to use the H-2A program due to the year-round aspect of the farms.

The guidance, released on Wednesday, now allows dairy operations to use the work visa program if they can demonstrate a temporary or seasonal labor need.
