FAIRFAX, VIRGINIA (May 12, 2020) — Americans for Limited Government President Rick Manning issued Tuesday the following statement blasting Judge Emmet Sullivan’s decision to consider amicus filings in deciding whether to allow the Michael Flynn case to be dismissed:

“The US District Judge overseeing the Michael Flynn case has just broken the judicial system with his decision to let stakeholders and others to express their views about the decision by the US Justice Department’s decision to drop the prosecution of Flynn with prejudice. The precedent that Sullivan is creating would allow the rioters in Ferguson, Missouri to have equal standing with the county prosecutor in deciding whether charges should be filed. Sullivan is opening the door to well funded interest groups to be able to override decisions by the elected President of the United States and his confirmed designee in the Justice Department. In fact, by opening up this case, he opens the door for any US citizen to contest in federal court the decision of the Obama Justice Department to not prosecute Hillary Clinton for her proven mishandling of classified materials.

“The Attorney General of the United States should contest this decision to the Supreme Court if necessary. Sullivan’s decision would turn our federal court system into a battle of stakeholders with little concern for justice for the accused, and it is antithetical to the most basic legal principles of our nation.”
