(DES MOINES) – Gov. E. Terry Branstad today signed a proclamation directing a special election to be held on Dec. 27, 2016, for Iowa Senate District 45, following the recent death of Senator Dr. Joe M. Seng of Davenport, IA.

Gov. Branstad considers Nov. 8th the best date for the special election, which would coincide with the general election, in order to ensure high voter turnout and save Scott County taxpayers the expense of another election.  However, Iowa Code allows the County Auditor to prevent a special election from occurring the same day of a general election if the County Auditor believes there are undue difficulties with administering both elections. 

The Scott County Auditor informed the Office of the Governor that she believed a special election on Nov. 8th would cause undue difficulties.  Due to the County Auditor’s objection to the special election occurring on Nov. 8th and the six week blackout period surrounding a general election, the special election for Senate District 45 can occur no sooner than December and therefore will be held on Tuesday, Dec. 27, 2016.

SPECIAL ELECTION PROCLAMATION

WHEREAS,      The Office of State Senator from the 45th Senatorial District, consisting of the following areas:

B.     The ninetieth district in Scott county consists of:

a.      That portion of the city of Buffalo and Buffalo township commencing at the point the west boundary of Scott County intersects the boundary of the state of Iowa, then proceeding north along the boundary of Scott County until it intersects the south corporate limit of the City of Buffalo, then proceeding first north, then in a clockwise manner along the corporate limits of the city of Buffalo until it intersects the west corporate limit of the city of Davenport, then proceeding south along the corporate limits of the city of Davenport until it intersects the boundary of the state of Iowa, then proceeding westerly along the boundary of the state of Iowa to the point of origin.

                          has become vacant by the reason of the death of Senator Dr. Joe M. Seng.

NOW, THEREFORE, I, Terry E. Branstad, Governor of the State of Iowa, by virtue of the authority vested in me by the law do hereby proclaim and direct that a special election to fill said vacancy shall be held within said District on

TUESDAY, THE 27TH DAY OF DECEMBER, 2016, A.D.

WHEREFORE, all electors within said 45th Senate District will take due notice and the County Commissioners of Elections of said counties will take official notice as provided in Iowa Code section 39.6.
