Loebsack Introduces Legislation to Support Student Success

Washington, D.C. - Congressman Dave Loebsack recently introduced legislation to address the importance of increasing access to critical services in schools to address the non-academic factors that affect students' ability to learn.  His legislation, the Reducing Barriers to Learning Act, would increase student access to school counselors, nurses, psychologists, social workers, specialized teachers, and community partners such as mental and physical health providers. Loebsack spoke about his legislation during an Education and the Workforce Committee hearing earlier this week.  Video can be found here.

"As a former educator, I recognize the importance of focusing on all of the factors that contribute to student success in order to promote learning and safe and supportive school environments.  Knowing who is available to help struggling students and those in need of more specialized supports is critical," said Loebsack.  "The Reducing Barriers to Learning Act will increase student access to critical services so that we can better address the non-academic needs of students and help them learn in the classroom by addressing issues such as depression, low-self esteem, and speech and language disorders.  This will not only set our children up for success both in school and in their future college and career pursuits, but will also support our teachers' efforts in the classroom."

Loebsack's bill would improve specialized instructional support services in schools and clarify the roles of specialized personnel to ensure they are able to best serve students' needs. It would also create a grant program to develop programs and train personnel dedicated to removing barriers to learning.

Spring / Summer Master Classes

This season the Curtainbox will be offering two acting master classes, each appropriate for all levels of acting experience. In each class the student will learn how to analyze the written material to build a compelling performance. We will discuss and practice creating a character, defining relationships, determining specific intentions, and making bold, yet appropriate choices which will all lead to a strong and effective performance.
Monologue and Song Performance Class
Tuesday, June 28th from 6pm-9pm
The novice actor should come prepared to learn. We will provide you with a short monologue on the day of the class.
The actor with experience or who has taken class before should bring in a memorized monologue or song. The material should not exceed 2 minutes and 29 seconds. If the student chooses to bring a song, he/she must provide either a CD with the recorded accompaniment or bring in their own method of reproducing the accompaniment. Cuts of songs are appropriate if the full song is too time consuming. Whether preparing a song or monologue the student is encouraged, though not required, to bring in the written version of the material for reference during class.The student may bring one additional monologue or song which will be addressed as time allows.
CLASS FEE: $75.00 / Student
Scene Study
Tuesday, June 11th from 6pm-9pm
The student will be assigned a particular part in a scene well in advance so that the student has sufficient time to memorize the scene before the night of the class. Come prepared to learn and explore along with your classmates and scene partners.

RIVER BANDITS-KERNELS POSTPONED THURSDAY

Teams will finish series with doubleheader Friday at 5 p.m.; gates will open at 4 p.m.

 

DAVENPORT, Iowa (MAY 9, 2013) - Thursday night's game between the Quad Cities River Bandits and Cedar Rapids Kernels at Modern Woodmen Park has been postponed. The game will be made up in a doubleheader beginning at 5 p.m. Friday. Gates will open on Friday at 4 p.m., and all tickets for Thursday's game may be exchanged for any other 2013 home game.

Quad Cities (19-11) and Cedar Rapids (21-9) have yet to announced pitching matchups for the doubleheader, although the first major league rehab for the Quad Cities at Modern Woodmen Park in seven seasons is scheduled to be a two-inning outing by Astros right-hander Josh Fields on Friday night against the Cedar Rapids Kernels.

Payment Limits Reform Included in Chairwoman's farm bill

Senator Chuck Grassley released the following statement after the Chairwoman of the Senate Agriculture Committee today released her "mark" that will be the baseline for debate when the committee begins consideration of the bill on Tuesday.  The bill includes payment limit reforms proposed by Grassley.  Click here for information about Grassley's payment limits reform package that he introduced in the Senate.  Click here for information about the support for Grassley's provisions during the budget debate.

"I appreciate Chairwoman Stabenow's continued commitment to farm program payments reform.  When two-thirds of the farm payments go to the wealthiest 10 percent of farmers and there are loopholes that allow farm payments to go to non-farmers, Americans lose confidence that we're using taxpayer money responsibly.  By including my reforms, Chairwoman Stabenow is putting forward a mark that is defensible and effective in this area.

"I was also pleased to see Congressman Fortenberry introduce companion legislation to my payment limits reform bill in the House today.  As the House Agriculture Committee considers a farm bill it would send a strong message if the House included the common sense and meaningful payment limit reforms in Congressman Fortenberry's bill and that Senator Stabenow has included in her mark."

House File 356 an Act relating to the statute of limitation periods in bringing suit and executing a judgment in an action on a claim for rent.

House File 487 an Act relating to a manufactured or mobile home retailer's application to a county treasurer for a certificate of title for a used mobile home or manufactured home.

House File 495 an Act relating to the residential landlord and tenant laws and related forcible entry and detainer laws and making penalties applicable

House File 545 an Act creating a new category of allowable expenditures from the Veterans Trust Fund.

House File 565 an Act relating to mechanic's liens and the mechanic's notice and lien registry.

House File 607 an Act relating to the state government, by providing for the transfer of powers and duties from the Agriculture Development Authority to the Iowa Finance Authority, the composition of the Iowa Finance Authority Board of Directors, implementation of law by the board, and including effective date provisions.

House File 631 an Act modifying provisions applicable to the propane education and research council.

Senate File 438 an Act relating to real estate broker and real estate salesperson licensing fees and allocations from those fees, and making an appropriation.

ASTROS SEND JOSH FIELDS TO PITCH REHAB IN QUAD CITIES

Right-hander will be first player to rehab with Quad Cities at Modern Woodmen Park since 2006

DAVENPORT, Iowa (MAY 9, 2013) - Houston Astros right-hander Josh Fields is scheduled to make a rehab appearance at Modern Woodmen Park Friday at 7 p.m. against the Cedar Rapids Kernels. Fields is set to become the first major leaguer to have a rehab assignment with Quad Cities at Modern Woodmen Park since 2006.

Fields, 27, made his major league debut April 2 against the Texas Rangers. He was the first overall pick by Houston from Boston in the Major League Rule 5 draft in December. This season he pitched two consecutive scoreless relief outings of 1/3 inning each before being placed on the disabled list with a right forearm strain April 8, with the move retroactive to April 4. Fields has not pitched since April 3 against Texas and is scheduled to pitch two innings in Friday's game against the Kernels.

A native of Athens, Ga., Fields was originally selected by the Seattle Mariners out of the University of Georgia in the first round (20th overall) of the June 2008 draft. He was acquired by the Boston Red Sox with left-handed pitcher Erik Bedard in a three-team deal that included the Los Angeles Dodgers on July 31, 2011. He finished the 2012 season with the Triple-A Pawtucket Red Sox before being selected by Houston in the Rule 5 draft in December. His minor league totals in the Mariners and Astros systems include 132 games - all relief appearances - an 11-8 record, 3.57 ERA and 23 saves in 176 2/3 innings.

The last major leaguer to have a rehab assignment with the River Bandits was former St. Louis Cardinals left-hander Brian Tallet, who pitched at Peoria on May 17, 2011. The last major leaguer to rehab for the Quad Cities franchise in Davenport was former St. Louis Cardinals left-hander Mark Mulder on Aug. 6, 2006, against the Clinton LumberKings.

Iowa CRP Meetings for Landowners Prior to Signup Hosted by PF

General CRP sign-up runs May 20th through June 14th

Iowa - May 7, 2013 - Pheasants Forever is hosting informational meetings across Iowa for landowners and agricultural producers in advance of the USDA Farm Service Agency's Conservation Reserve Program (CRP) general sign-up that runs May 20th through June 14th. Led by Pheasants Forever Farm Bill Wildlife Biologists, landowners can learn how to increase their farm or ranch income while creating wildlife habitat in the process.

"It is Pheasants Forever's belief that there is room for conservation on every farm and ranch in the country," says Dave Nomsen, Pheasants Forever's Vice President of Government Affairs, "Just a look at recent history - from a wet cycle to a historic drought last year - showcases this need for conservation. Programs like CRP provide stability for producers on lower-yielding, tougher-to-farm acres, while simultaneously serving as America's top habitat tool for pheasants and quail."

At CRP informational meetings, Pheasants Forever Farm Bill Wildlife Biologists will discuss how the Conservation Reserve Program works, and provide landowners with expertise on increasing the chances of their acreage qualifying for the program. While a majority of meetings are occurring prior to the opening of CRP General Sign-Up 45, in some areas meetings extend into the first few weeks of the open sign-up period.

Nomsen encourages landowners to attend the meetings and to not assume there's no room for conservation practices in an era of record crop production and prices. "CRP rental rates may be significantly higher in some areas than in years past, some CRP practices allow for haying and grazing, others encourage pollinator habitat, and those pollinating insects are also necessary for agricultural production. Every farm in the country, whether it's 200 acres or 2,000 acres, has a percentage of acreage in production that annually loses money. So we're looking to work together with landowners to identify these areas and help their bottom line, and also help Pheasants Forever's bottom line of conserving wildlife habitat."

The CRP informational meetings are organized by Pheasants Forever, Quail Forever, the Farm Service Agency and the Natural Resources Conservation Service.

Landowners who can't make a CRP informational meeting are encouraged to make an appointment with their local Pheasants Forever Farm Bill Wildlife Biologist or visit their local FSA office.

Pheasants Forever, including its quail conservation division, Quail Forever, is the nation's largest nonprofit organization dedicated to upland habitat conservation. Pheasants Forever and Quail Forever have more than 135,000 members and 730 local chapters across the United States and Canada. Chapters are empowered to determine how 100 percent of their locally raised conservation funds are spent, the only national conservation organization that operates through this truly grassroots structure.

32 Iowa students win National History Day in Iowa contest

Students advance to national contest at University of Maryland next month

DES MOINES - Thirty-two Iowa students took top honors in a statewide history contest this week and will represent Iowa at the National History Day competition next month at the University of Maryland.

The 32 students competed against 375 other students in the junior division (grades 6-8) of the National History Day in Iowa contest this week at the State Historical Museum of Iowa in Des Moines. The students join 38 other Iowa students who competed last week in the NHD in Iowa senior division (grades 9-12) in advancing to the 2013 Kenneth E. Behring National History Day Contest held June 9-14, 2013, at the University of Maryland.

The group of 70 Iowa students will compete for scholarships and cash prizes against nearly 2,500 students from the United States, Guam, America Samoa, Department of Defense Schools in Europe, and Shanghai, China

National History Day is an academic-enrichment program that helps students learn about historical issues, ideas, people and events. The year-long academic adventure fosters students' enthusiasm for learning and encourages them to use primary, secondary, community and statewide resources on a subject of their choice related to an annual theme. The theme for 2013 is "Turning Points in History: People, Ideas, Events.

Working individually or collaboratively in groups of two to five, students compete in the following categories: historical papers, individual and group exhibits, documentaries, performances and websites. Nearly 10,000 Iowa students competed in the program this year, with winners at school and district competitions advancing to the state contests in Des Moines.

In addition to helping students discover the world of the past, the NHD program helps them develop the following attributes that are critical for future success:

  • critical thinking and problem-solving skills
  • research and reading skills
  • oral and written communication and presentation skills
  • self-esteem and confidence
  • a sense of responsibility for and involvement in the democratic process

The NHD in Iowa program has been coordinated by the State Historical Society of Iowa since 1994 and is sponsored by the State Historical Society, Inc., and the History Channel. The DCA preserves, researches, interprets and promotes an awareness and understanding of local, state and regional history and stimulates and encourages the study and presentation of the performing and fine arts and public interest and participation in them. The Iowa Supreme Court has approved rules governing electronic appellate processes. The rules, to be contained in the Chapter 16 court rules pertaining to EDMS, are prospective only. The court will announce an effective date for the rules and for implementation of electronic filing in the appellate courts at a later date.

Earlier this year, the General Assembly approved statutory changes that prohibit the possession, receipt, and shipment of firearms and ammunition by a person found by a court to be mentally ill. To comply with this legislation, the court amended two forms used for civil commitments pursuant to Chapter 229 of the Iowa Code.

Iowa Court Rules (November 10, 2011)

Amendment to chapter 11 of the Iowa Court Rules? Adoption of Standards of Conduct for Mediators Summary?At the recommendation of the Iowa State Bar Association, the American Academy of Alternate Dispute Resolution Attorneys, and others, the court replaces chapter 11 of the Iowa Court Rules, "Rules Governing Standards of Practice for Lawyer Mediators in Family Disputes," with new standards of conduct for mediators. The current standards have changed little since their adoption in 1987. The new standards mirror the 2005 Model Standards of Conduct for Mediators with one exception. The court added a provision concerning the scope of the rules. This provision provides that the "standards apply to mediators who are lawyers licensed to practice law in Iowa, mediators who participate in any mediation program approved by a court of this state, and mediators in any matter required to be mediated by an Iowa court order or rule." The standards for mediators in the prior version of chapter 11 applied to lawyer mediators in family disputes only. The new standards take effect January 1, 2012.

Amendment to Rule 41.12 requires all lawyers newly admitted by examination to complete a basic skills course on Iowa law within one year after admission to the Iowa bar. The supreme court amends the rule to permit new lawyers to take the basic skills course during the time between completion of the bar examination and admission to practice.

Amendments to Rules of Civil Procedure 1.1007 and 1.1008--Time to file certain post-ruling motions
These amendments increase the amount of time that a party has to file certain post-ruling motions. The court increased the time to file such motions from ten days after the filing of a verdict to fifteen days after the filing of a verdict. This additional time is intended to address case processing delays that cut into the time parties have to file such motions. These delays are the on-going consequence of the severe cuts in the judicial branch budget over the past decade.

The former version of the rule required reporting of these remarks only upon request of a party. The purpose of this amendment is to ensure that a complete record of all aspects of a trial exists to enable a complete review of a case on appeal. Under the former rule, the absence of a record of opening statements and closing arguments frequently hampered appellate review, particularly with regard to questions of error preservation and prejudice.

Summary?Earlier this year, the court amended this rule to require the payment of a filing fee when filing a motion or petition for vacating or modifying a judgment. Later, the court was informed of confusion among clerks of court and attorneys about the application of this rule, particularly with respect to small claims cases. Clerks of court asked for guidance. To clarify the rule, the court adopted this amendment. The amendment clarifies that a petition of this nature when filed in small claims shall require payment of the fee for filing a small claims case set forth in section 631.6(1)(a). Currently, the filing fee for small claims cases is $85.
