DAVENPORT, IA- On January 24, 2014, Manuel Partida Garcia, age 32, a citizen of Mexico, was sentenced by United States District Court Judge John A. Jarvey to 36 months imprisonment, after pleading guilty to illegal re-entry into the United States, announced United States Attorney Nicholas A. Klinefeldt. Partida Garcia was also ordered to serve three years of supervised release and pay $100 towards the Crime Victims Fund. Partida Garcia was found in the United States after being convicted in Marshall County, Iowa for possession of methamphetamine with the intent to deliver, eluding and carrying weapons. Partida was also found to be an aggravated felon based on a prior assault conviction out of the state of Washington.

This case was investigated by the United States Department of Homeland Security-Immigration and Customs Enforcement, and the case was prosecuted by the United States Attorney's Office for the Southern District of Iowa.

Investor protections, broker expungement rate, FINRA response

WASHINGTON, DC - In an effort to protect investors and the integrity of the Financial Industry Regulatory Authority's (FINRA) BrokerCheck program, U.S. Senators Jack Reed (D-RI) and Chuck Grassley (R-IA) sent a bipartisan letter last month asking FINRA to clarify and strengthen standards for expungement of investor complaints against brokers.  After receiving a written response from FINRA and a follow up meeting this week with staff from the offices of Senators Reed and Grassley and FINRA officials, the senators today issued the following joint statement:

"FINRA was responsive to our inquiry and it appears the organization is taking this problem seriously.  We will continue to follow up and work closely with  FINRA to ensure that it follows through on its commitment to improve the expungement system.  It is important for consumers to have the unvarnished information they need.  We hope FINRA will take a direct role in making sure this happens."

As those directly affected, we hope the GOP principles are not a political stunt just to stall immigration debate, rather, that they are common sense principles that will quickly be translated into legislation to finally modernize our outdated immigration system. At the same time, there must be principles to which Democrats must adhere to ensure proper deliberation, realistic efforts and good faith collaboration. CORE PRINCIPLES FOR REPUBLICANS
  • Clear channels for all undocumented immigrants to live without fear of deportation, work, travel, and become full contributing members of the U.S.
    • The US is a nation of immigrants and we should give an opportunity and provide an efficient process for all undocumented immigrants to become part of our tradition of the American Dream; thus, Republicans can't permanently block citizenship.
  • Modernize Visa System
    • Individuals seeking to immigrate to the U.S. repeatedly encounter a cumbersome and long process that has a high financial cost and likelihood of failure to families and businesses. This should be modernized to allow a smoother flow with fewer costs and less bureaucracy.
  • No criminalization of undocumented immigrants through interior enforcement
    • There is a large economic burden on states and local governments enforcing immigration law. Lift the heavy burden of immigration enforcement from state and local police departments; Local and state enforcement should focus their limited resources on protecting their neighborhoods and cities, not act as immigration agents.
    • Congress must seek the input and adapt the concerns of communities at the border before developing a border security plan; There are numerous complaints about human rights abuses at the border, as well as in detention.  We should push for humane treatment for communities and individuals at the border and in US custody;
    • Detention reform that halts costly incarceration of nonviolent undocumented immigrants and allows for programs that keeps families together.
CORE PRINCIPLES FOR DEMOCRATS
  • Engage with Republicans on legislation in good faith
    • Democrats need to reach out to Republicans to craft practical legislative solution for immediate relief for families to allow undocumented immigrants to work, travel, and become full contributing members of the U.S.
  • No political hard lines
    • Hard lines have dashed immigration reform before.  Focus on advancing substantive policy this year, not electoral politics.
    • Let go of HR 15 and SB 744 and focus on winnable pieces of legislation in the House.
  • Address Urgency and Crisis of deportation and Family Separation
    • Urge President Obama to expand administrative relief and stop arbitrary deportations.
    • Congressional Hispanic Caucus must lead on urging administrative relief from deportations.

U.S. Citizens Appreciate the Character of Those Protecting Them, Says Former Intelligence Officer

They're called "The Few. The Proud;" does that mean the many Americans who admire the U.S. Marines never hope to become more like them? Eric Wentz, a highly decorated military intelligence specialist who served his country for 26 years, says yes.

"For many, the Marines embody all that the men and women of the United States military stand for, which includes a principled lifestyle that ultimately serves to defend the democratic values espoused in our constitution, and our love for freedom," says Wentz, a former intelligence officer and author of a new Readers Choice Award-winning novel based on his experiences, "Killing Sharks: De Profundis," (www.ericwentz.com).

"There really are bad actors throughout the world who want nothing more than to see the destruction of our civilization - all that was built by our founding fathers and continued throughout the generations - to be replaced by a foreign ideology. The Marines are often the first to prevent that from happening." 

Wentz explores four defining characteristics of Marines that any American can emulate:

• An adherence to honor and integrity - Semper Fidelis: The translation of the famous Latin phrase is "always faithful" - faithful to the present mission, to fellow Marines and to the United States, no matter what. Recruits who enter into basic training undergo a transformation that lasts a lifetime. Once a Marine, always a Marine, expected to forever live by the ethics and values of the Corps: an aversion to lying, cheating and stealing; an uncompromising code of personal integrity; a love for accountability, self-reliance and discipline. Honor, courage and commitment are the bedrock of a Marine's values. Similar codes can be found throughout history, including the chivalry of Medieval knighthood and codes found among other fabled warriors, including the Spartans and Trojans.

• A commitment to physical fitness: Part and parcel to a code of values is the commitment to physical fitness. Marines are warriors who must be able to overcome all manner of physical obstacles. Sadly, for many Americans, a serious physical challenge is fitting into an airplane coach-class seat. With such a small percentage of Americans making up our military, less than 1 percent, compared to a high percentage of overweight citizens, it's easier to see why Marines are viewed with high esteem. Physical fitness is the outward reflection of the inner character demanded of these warriors.

• Willingness to sacrifice: Military members fighting in wars are routinely asked to make the ultimate sacrifice by putting one's life on the line to complete a mission. If a life isn't lost, a Marine's limbs or mental and emotional well-being may be. Sacrifice also means doing several tours in a war zone, half a world away from family, to exist in a hostile environment. Many individuals forgo a comfortable and profitable life at home in order to fight for the greater good of all Americans.

• Fear of commitment is not an option: A Marine recruit simply cannot pussy-foot his or her commitments; you cannot be a runaway bride or an uncertain, hand-wringing groom. Marines must be gung ho in the face of adversity. They are individuals of action and consequence, and there can be no debate with a superior when asked to risk one's life for the good of the mission. Luckily, civilians rarely face such demands. However, as Wentz points out, if they demonstrate such commitment to integrity in finances, health, business, civic and personal obligations, they'll also do their part in contributing to the strength and defense of the nation.

WASHINGTON - Sen. Chuck Grassley of Iowa today asked the Federal Trade Commission (FTC) to review the conditions that have led to propane cost spikes in Iowa. 

"The recent propane supply shortage and price increases are causing hardship for the many rural Iowa families that use propane to heat their homes," Grassley said. "I'm asking the agency that oversees business practices to look at the propane situation and see whether the price increases are legitimate or manipulated in any way to consumers' detriment." 

In the meantime, Grassley encouraged anyone who may be eligible for federal heating assistance to contact the Iowa Bureau of Energy Assistance for more information.

I am writing to inquire about the Federal Trade Commission's oversight of the propane market in the Midwest.

In recent days, the Midwest spot price of propane at Conway, Kansas, has spiked far above the Gulf Coast spot price at Mont Belvieu, Texas.  I recognize that in the fall, the demand for propane to dry the large, wet corn harvest was significant.  In addition, the Midwest has experienced increased demand for propane due to the current cold weather.  However, the price for propane at Conway has surpassed the spot price in Mont Belvieu by as much as several dollars.  Many of my constituents have questioned this considerable price differential.  Moreover, in just the past few days, the spot price for propane in the Midwest has doubled.

I request that the Federal Trade Commission remain vigilant in overseeing the propane market to prevent possible anti-competitive behavior or illegal manipulation, and to ensure that any supply shortages are not created artificially.  I look forward to hearing the results of your review of the propane market in the Midwest.

Hearing in the Heartland: Supporting the Renewable Fuel Standard  

January 23, 2014  

   

I'd like to thank Governor Branstad and all the state officeholders for co-hosting this event with me.  I'm happy to be here to facilitate the process of representative government.   

   

The proposal released by the Environmental Protection Agency in November is harmful to biofuel producers, to Iowa's rural economy, our national security and our environment.   

   

Your voices in opposition to this proposal need to be heard.  

   

I'm glad to be here to join you in sending a strong and loud message to undo this irresponsible proposal.  

   

I've long been a staunch supporter of Iowa's ethanol and biodiesel industries.  I know the value that biofuels have brought to our state.   

   

Small rural communities all across the 99 counties have benefited from more than 50 ethanol and biodiesel facilities.   

   

Iowa leads the nation by producing more than 4 billion gallons of biofuels annually.  

   

This investment has improved the environment.  It's improved the economic well-being of Iowans.  It's improved our balance of trade and our national security.   

   

Iowa's farmers have led the world in producing the food, feed, fiber and fuel that consumers demand.  

   

In recent years, I've fought off efforts to undermine homegrown renewable energy by Big Oil and Big Food.  

Biofuel proponents have dispelled the myths and misinformation campaigns that have been launched to discredit ethanol and biodiesel.

And once again, you're being called to respond to another attack. 

This one is aimed at the Renewable Fuel Standard and comes from President Obama's Environmental Protection Agency.

In 2005 and again in 2007, the federal government made a commitment to homegrown, renewable energy when Congress passed the Renewable Fuel Standard. 

The Senate passed the greatly-expanded Renewable Fuel Standard in 2007 by a vote of 86-6.  It was signed into law by President Bush. 

In signing the bill, President Bush stated,

"We make a major step toward reducing our dependence on oil, confronting global climate change, expanding production of renewable fuels and giving future generations a nation that is stronger, cleaner and more secure."

President Bush was labeled by his political opponents as "an oil man from Texas." 

In 2007, this "oil man from Texas" championed the RFS as a way to reduce our oil dependence, clean our air and increase our economic and national security.

Iowans responded to the federal government's call for more renewable fuels.  Iowa produces nearly a third of the nation's ethanol. 

The 12 biodiesel plants in Iowa produce more than 300 million gallons annually.  Billions of dollars have been invested in these facilities. 

Farmers have invested in higher-yielding, drought tolerant seeds. 

Enormous investments have been made in bringing the next generation of cellulosic biofuels to commercial production. 

Iowans have responded to the call for more homegrown, renewable energy.  But, the proposed rule released by the EPA undermines that commitment. 

This misguided proposal will cost jobs in Iowa and across the country. 

If allowed to take effect, it'll increase our dependence on oil, and protect the stranglehold that Big Oil has on our country's fuel supply. 

The proposal by the EPA doesn't simply intend to pause the growth in renewable fuel; it actually proposes to roll it back. 

EPA seems to be making this decision based on the amount of biofuels that can be blended in our gasoline pool. 

The problem is, EPA has fallen for Big Oil's argument that we've hit a blend wall.

The blend wall is a creation of the oil industry.

Congress knew in 2007 that ethanol would have to be blended above 10 percent to meet the mandate. 

The RFS was created by Congress to pull biofuels into to the market. 

It was created with the intention to transform our fuels market toward E85 or E30 or E15.  Limiting the RFS to levels that can be met with existing infrastructures eliminates the incentive to invest and develop the next generation of biofuels. 

The EPA proposal undermines the efforts toward advanced biofuels taking place right now in Emmetsburg and Nevada.

This proposal is a reward for Big Oil's stubbornness.  The EPA has essentially decided to put oil producers in charge of the Renewable Fuel Standard. 

Just because the petroleum industry has stonewalled the infrastructure of higher blends doesn't mean we should capitulate on the policy.   

It's disappointing that a President who claimed to be a supporter of renewable energy has allowed his administration to take a step back in lessening our reliance on foreign sources of oil.   

I won't stand for it. 

I've lobbied Agriculture Secretary Vilsack and the EPA Administrator personally.  I've lobbied President Obama's staff. 

This week, I'll lead a letter with Senator Durbin, along with nearly 30 other Senators, to EPA Administrator McCarthy that expresses our opposition to this proposal.

I encourage all of you to do the same and let your voice be heard with EPA. 

I hope President Obama will to step in and get personally involved.  He needs to realize that this proposal is a big win for Big Oil.   

It's time for supporters of clean, homegrown, green energy and forward-thinking energy policy to rally and let the Obama administration know that its proposal is short-sighted and irresponsible.

Veteran Investment Advisor Shares 4 Tips for All Wealth Stages

Financial resolutions can be the most difficult to keep. They can include minute detail, number crunching, plenty of files and discipline that can affect a person's entire lifestyle, says veteran investment advisor Paul Taylor, a member of the National Ethics Bureau.

"Many folks simply are not predisposed to combing through the details of their financial situation; for them, the financial world is abstract and filled with arbitrary rules, constantly changing interest rates and other complexities, but being more involved in your own money is well worth the investment," says Taylor, an architect-turned-founder and owner of Capital Advisory Group & Tax Planners of Lake Norman and Capital Investment Advisors, Inc, (www.CapitalAdvGroup.com).

"While professional help is recommended for many aspects of a person's financial affairs, it's ultimately up to the individual to understand his or her own money."

There are many things the average person can do to take control of their financial life. Taylor offers the following suggestions:

• For your cash flow, keep in mind the four A's: Accounting, Analysis, Allocation and Adjustment. The four A's describe a systematic and disciplined approach to your daily, weekly, monthly and yearly spending habits. Accounting involves gathering all your relevant financial information - income, recurring bills, and other expenditures - creating a central list of each item, and pulling it together in a place where it's easily accessible.Analysis is reviewing the information to determine whether you have a shortfall or surplus, and finding places to reduce expenses. Saving $100 a month on dining out, for instance, would allow you to apply $100 to your mortgage loan principle, saving you a substantial amount in interest payments. Allocation involves determining your financial commitments and priorities, needs versus wants, and distributing your income accordingly.Adjustment involves periodic reviews of your financial information and shifting assets to meet changing needs.

• Utilize estate planning tools such as wills and trusts; make sure the details are accurate. Wills and trusts allow you to spell out how you would like your property to be distributed, and much more. A will gives you the opportunity to nominate your executor and guardians for your minor children. If you fail to make such designations through your will, the decisions will probably be left to the courts. Bear in mind that property distributed through your will is subject to probate, which can be a time-consuming and costly process. Trusts, which are more complex, let you customize the distribution of your estate with the added advantages of property management and probate avoidance.

• Start planning your retirement sooner rather than later. There are a variety of retirement planning options that can meet your needs. Your employer funds some; you fund some. Bear in mind that, in most cases, early withdrawals before age 59½ may be subject to a 10 percent federal income tax penalty. The latest date to begin required minimum distributions is usually April 1 of the year after you turn age 70½. Withdrawals from tax-deferred plans are taxed as ordinary income. The top planning options include defined benefit pension; money purchase pension; profit-sharing plan; savings plan; employee stock ownership plan; tax-sheltered annuities; individual retirement accounts; self-employed plans; simplified employee pensions; and savings incentive match plans for employees.

• Remember the first commandment in safe investment:diversification. Virtually every investment has some type of risk associated with it. Don't put all your eggs in one basket. Diversification is one of the main reasons why mutual funds may be so attractive for both experienced and novice investors. Many non-institutional investors have a limited investment budget and may find it challenging to construct a portfolio that is sufficiently diversified. For a modest initial investment, you can purchase shares in a diversified portfolio of securities. Depending on the objectives of the fund, it may contain a variety of stocks, bonds and cash vehicles, or a combination of them.
